Terms and Conditions.


These Terms and Conditions (hereby known as “Terms”) govern our relationship with users, visitors or any other individuals or entities that access the services (“User”) of The Institution’s website community.ecoban.com (the “Website”), hereinafter “The Institution”.
Please read these Terms carefully before using The Institution’s Website and the App. The User’s access to and use of the Website and the App is conditioned by their acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use The Institution´s services in connection with ECKs (the “Service”). By accessing or using the Service, the User agrees to be bound by these Terms. If the User does not agree to any part of the Terms, they may not access the Service:

 

User Account.


When the User creates an account with The Institution, they must provide The Institution with accurate, complete, and current information. Failure to do so constitutes a violation of the Terms, which may result in the immediate termination of the User’s account on the Service. The User is responsible for protecting the password used to access the Service and for any activity or action under said password, whether the password be for this Service or for a third-party service. The User agrees not to disclose their password to any third party. The User must notify The Institution immediately upon becoming aware of any breach of security or unauthorized use of their account. When the User creates an account, the Service will sign them up for the Institutional newsletter to keep them up to date regarding any developments within the company.

 

Links to other sites.


The Service may contain links to third-party websites or services that are not owned or controlled by The Institution. The Institution has no control over, and assumes no responsibility for the content, Privacy Policies, or practices of any third party websites or services. The User further acknowledges and agrees that The Institution shall not be responsible or liable, directly or indirectly, for any damage or loss caused by (or alleged to be caused by) or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly encourage the User to read the Terms and Conditions and Privacy Policies of any third party websites or services that the User may visit.

 

Termination.


The Institution may terminate or suspend the User’s account immediately, without notice or liability, for any reason, including, without limitation, if the User breaches the Terms. Upon termination, the User’s right to use the Service will immediately cease. If the User wishes to terminate their account, they may simply discontinue using the Service.

 

Limitation of Liability.


In no event shall The Institution or its directors, employees, volunteers, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages; including and without limitation: loss of profits, data, use, goodwill or other intangible losses, resulting from (i) the User’s access to, use of, or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of the User’s transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not The Institution has been advised of the possibility of such damage, and even if it is determined that a remedy set forth herein has failed its essential purpose.

The User uses the Service at their own risk. The Service is provided to the User without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, suitability for a particular purpose, non-infringement, or course of performance. The Institution, its subsidiaries, affiliates and its licensors do not warrant that a) the Service will operate uninterrupted, secure or available at any particular time or location; b) errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet the User’s requirements.

 

Governing Law.


These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. The Institution’s failure to enforce any right or provision of these Terms will not be deemed a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between The Institution and the User with respect to the Service, and supersede and replace any prior agreements that may have existed between The Institution and the User with respect to the Service.

 

Changes.


The Institution reserves the right at its sole discretion to modify or replace these Terms at any time. If a significant revision is made, The Institution will attempt to provide at least thirty days notice before the new Terms become effective. What constitutes a significant change is at the sole discretion of The Institution. By continuing to access or use the Service after those revisions become effective, the User agrees to be bound by the revised Terms. If the User does not agree to the new Terms, they should discontinue using the Service.

 


Privacy Policy.


This Privacy Policy Notice details how The Institution collects and uses corporate information. This policy applies to data collected from: Website and app users, those who subscribe to the Institution’s newsletter, those who send The Institution emails or text messages, and those who contribute to The Institution’s research via anonymous surveys used for educational and research purposes. By completing any survey, the User consents to the processing of their data for publication in research papers, academic papers, and presentations. All data will undergo anonymization prior to publication or presentation.

 

Policy Statement.


The Institution is committed to complying with current legislation (namely the General Data Protection Regulation (GDPR)), complying with good practice procedures, respecting the rights of individuals, being open and honest with the Users whose data it stores, protecting clients, staff, research participants, and others involved in its work, and providing training and support to staff who handle corporate data so that they can act with confidence and consistency. Should a data breach occur, all affected individuals will be notified.

 

Legal Databases to be Processed.


The Institution takes appropriate security measures to prevent unauthorized access, disclosure, modification or unauthorized destruction of Corporate Data. The Institution in the processes Corporate Data relating to the Data Subject only if one of the following applies:

o Retention time: User data is processed and stored for as long as necessary to fulfill the purpose for which it was collected.

The rights of the User with regards to their data.
With regards to the Users’ data, the User has the rights to the following:
To be informed with transparent information and receive communications from the Data Controller at the time of data collection.
To withdraw their previously given consent at any time regarding the processing of their corporate data.
To access their user data, view the data being used, and see how the data is being processed. Furthermore, the User can request a copy of this data.
To verify, correct or update any data in possession by The Institution.
To restrict the processing of their user data.
Users may request that The Institution cease the processing of their data, in which case the data will be stored for its original purpose or deleted.
Data portability may occur by having the User’s data transferred to another controller. Subjects can obtain their data in an appropriate, readable format, transfer it to another controller, and delete it from the previous controller.
